SylphNode Terms of Service Agreement
This terms of service agreement (the “Terms of Service Agreement”) governs the terms and conditions under which SylphNode.com (“SylphNode”) will provide hosting products and services (the “Products and Services”) to customers (defined below) described in the order form submitted in connection with these Terms of Service (the “Order Form”). For the purposes of these Terms of Service, “Customer” means the entity, or if being acquired by a person, the person executing this online transaction through a click-through agreement.
WE RESERVE THE RIGHT TO MODIFY, CHANGE, ALTER, REPLACE OR SUSPEND, FROM TIME TO TIME, IN ITS SOLE DISCRETION, ALL OR ANY PART OF THESE TERMS OF SERVICE, THE SLA, THE AUP AND ITS PRIVACY POLICY. CUSTOMER REPRESENTS AND WARRANTS THAT CUSTOMER HAS READ, UNDERSTOOD AND ACCEPTED THE TERMS OF THE SLA, AUP, PRIVACY POLICY AND THESE TERMS OF SERVICE.
General
By accessing and using this site, you accept and agree to follow the terms of service of this agreement. When using the particular services of this site, you will be subject to any posted guidelines or rules applicable to such services, which may be posted and modified from time to time. All such guidelines or rules are incorporated by reference into the TOS. These other agreements include our Usage Policy and Privacy Policy.
Account
We reserve the right to close your account at any time, with or without notice. Your account will be closed if you are found violating any of these terms.
To register on our site, a valid email address is required. Registration with a false email address will result in the termination of your account.
By placing an order for a service from SylphNode, you are only renting the service. All services remain the property of SylphNode.
Payments
SylphNode will activate the purchased products and services once payment has been received and verified not to be fraudulent. In most cases, payment verification is automatic, but in exceptional circumstances, it may require manual review.
In the event of chargebacks or reversed transactions made to your account, your account will be terminated immediately and you will be prohibited from using our services in the future.
SylphNode will automatically terminate expired services.
It is your responsibility to cancel your service at sylphnode.com. If you do not cancel your service, it will automatically renew.
It is your responsibility to cancel automatic payments after your service has been cancelled.
Refunds
We offer a 48 hour refund policy on your first purchase from us. If you are not satisfied, you have the option to request a refund. Refunds are not allowed after 48 hours or on subsequent purchases. If you want a refund, you must request it using a ticket. This policy excludes payments made using cryptocurrency (e.g. Bitcoin).
Customers are only eligible to have a single 48-hour refund approved on their account.
SylphNode account credit is non-refundable.
No refunds or account credit will be issued for premature cancellations.
Service Level Agreement
We offer 99.9% uptime on our game hosting services. This excludes maintenance and events that are outside SylphNode’s direct control, such as, but not limited to, acts of God.
In the event SylphNode is unable to provide 99.9% uptime, the customer may request a prorated credit for any downtime within 2 days of the event.
Planned system maintenance or events outside SylphNode’s direct control do not count toward our uptime. Disruption can only consist of unplanned downtime. The inability to connect due to your own connection problems is not our responsibility.
Data Loss and Liability
SylphNode takes no responsibility for the data hosted on our service. You agree to take full responsibility for and maintain an adequate backup of files and data stored on our servers. Any backup services provided by SylphNode, whether paid or unpaid, are provided without any warranty.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYLPHNODE PROVIDES ALL PRODUCTS AND SERVICES “AS IS”, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Usage Policy
The servers may only be used for the services for which they were designed and you may not install or use unauthorized third-party programs. We provide technical support for needs such as help with our Pterodactyl Panel and server hosting issues, and we will not be responsible for any third-party software loaded on our services. Unauthorized use, such as attempting to access or interfere with other customers’ data, will result in suspension of your services.
Circumvention of any limits or restrictions with which your service has been provided, such as limited allocations, RAM limits or CPU restrictions, or any usage restrictions, will result in the suspension of your services without any refund.
Its use must be reasonable and must not place an excessive load on our hardware or available resources. You must not interfere with the services we provide to other clients. In exceptional situations, we may impose restrictions on your services if your use interferes with the services provided to other customers.
Servers should only store game-related data. They are not intended to store personal files, backups, etc. If storage usage disrupts other game servers on the same node, we have the right to suspend their service until a solution is found.
Abusive Behaviour Policy
We take pride in the services we provide to our clients. All members of our team are eager to assist our clients and ensure their success in executing their services with us. We approach customer service with your goals and needs in mind, wanting to resolve your concerns as quickly as possible. However, abusive language and behaviour can make it difficult for our support team to help you find a solution. Examples of this behaviour may include derogatory language, personal attacks, threats of violence against you or others, and spamming, among others.
We look forward to serving you. Doing so requires preserving our business and ensuring our employees feel safe at work. To that end, when an individual or group becomes threatening or abusive toward our team, we may need to take steps to protect our employees. These actions may include:
- Limit access to support
- Cancel our services
- Report to the authorities

Prohibited Uses
You must use SylphNode services only for legal purposes. The transmission, storage or presentation of any information, data or material in violation of the laws of Illinois, United States is prohibited. Action will be taken against any material that SylphNode deems threatening or obscene.
The following are strictly prohibited uses and may result in immediate suspension and/or termination if discovered on your account:
- Illegal Activity
- Denial of Service (DoS) Attacks
- Port Scanning
- Botnets
- TOR Exit Nodes
- Open Proxies
- Open DNS Resolvers
- Illegal Downloads/Hacking
- Public video chat (e.g. CamFrog, Visichat)
- Virtual currency/cryptocurrency mining (*coin mining)
- Crypto verification (SmartNodes, etc.)
- Facebook trackers
- IP address spoofs
- Fake/replica product websites
- Phishing
- World Community Grid, Folding at Home or similar software
- Prime95
- CrystalMines
- HYIP websites
- Booter/Stresser websites
- HitLeap or any artificial traffic creation
- Multics, CCcam or any other card swapping software
